Association Rules Enforcement Program
The Board of Directors is charged with the responsibility of enforcing all of the rules and regulations of the Association in order to provide for a pleasant and harmonious community for all residents. All owners, lessees and guests are bound by the legal documents to abide by the rules of the Association. Owners who lease their units are advised that they may be held liable for action of their tenants and so it is imperative they advise their agents and/or tenants of the rules of the Association.
In consideration of the above, the following will be strictly adhered to by all:
1. All suggestions, rules violation reports, common area service requests, complaints, etc., must be given to the Board of Directors or its Management Agent in writing.
2. No complaints of any kind will be taken verbally by any member of the Board of Directors or its Management Agent.
Rules Violation
Responses to all deed restriction violations shall be in the following manner:
1. Management will send a letter to the offending party, which clearly states the fact that a complaint has been received or noticed by Management, which alleges that a rules violation has taken place. Recipients of the letter shall have 20 days to comply except in the case of sod and landscaping violations, which shall have 30 days for compliance.
2. If no compliance, a second violation letter will be sent to the offending party. This letter will be a little more forceful and will contain a deadline of when the infraction needs to be completed. Management will give 14 days to resolve the violation. Sod and landscaping issues shall have 30 days to comply.
3. After expiration of the second violation letter, if the infraction was not addressed, a third and final letter may be sent. This letter notifies the owner that the violation will be turned over to the Association’s attorney unless they contact the Association within 7 days (date will be shown on the letter as well). Sod and landscaping issues shall have 30 days to comply.
4. If the violation has not been corrected pursuant to the third letter, after majority vote of the board of Directors at a duly called meeting, Management may forward the file to the Association’s attorney to commence legal action.
If the homeowner requests the name of the person who filed the complaint, Management and
the Board should keep such information confidential.
